The Seller is willing to take second pick puppy from the very first litter that the buyer produces from the dog in this agreement. If there is only 1 female in the first litter, the seller reserves the right to pick the 1st pick puppy on the second litter the buyer produces with the female listed in this agreement. If there are no living females in the second litter, the seller will pick a male puppy from the litter.SECTION 3 - Second Pick Definition *- For the purpose of this agreement the definition of second pick will be, the favorite puppy of the seller, other than 1 select puppy the buyer picks as the best puppy in the liter.SECTION 4 - First Pick Definition *- For the purpose of this agreement the definition of first pick puppy will the preferred best puppy in the litter by the seller.SECTION 5 - Buyers Obligations *- The Buyer agrees to show all puppies in the litter to the seller on any litters shown.SECTION 6 - Seller Obligations *- The Seller agrees to make a timely pick after being shown all of the puppies, within whatever time frame the Buyer would like the seller to pick their puppy. That could be day one of birth, or at 8 weeks old. The Seller will pick at anytime that the Buyer prefers to conduct sales to other clients.SECTION 7 - If the pick puppy dies *- If the puppy has been selected and passes away before pickup, the seller and buyer agree, that another puppy that has not already been pressed to the buyers client can be chosen, or a puppy from the next litter will be given to the seller.SECTION 8 - Quality *- The seller agrees that the health of the puppy selected as the puppy back is sold as is. The buyer has no guarantees as to health or breeding soundness of the puppy picked by the seller.SECTION 9 - Non Fullfilment *- The seller and buyer agree, that if the puppy back is not given as payment within 3 heat cycles of the bitch, the seller can demand a fee of $2,500 as payment for the dog listed in this agreement.SECTION 10 - Care *- The buyer agrees to provide adequate care, shelter, and food to the dog.SECTION 11 -AKC Paperwork *- The seller agrees that the dog listed in this agreement is AKC registered. The Seller is required to hand over physical hard copies of the AKC registration papers as the time the seller picks up the pick puppy. The AKC documents will be signed by the seller and all AKC registration will transfer to the Buyer listed in this agreement.SECTION 12 - FINACIAL BURDEN OF CARE *- The buyer will assume any and all veterinarian cost and any other expenses that might be incurred in connection with with the breeding of this dog.SECTION 15 - Pick Up *- The Seller is responsible for all cost associated with the timely pick up of the puppy that the seller picks when the puppy is old enough to leave.SECTION 18 - County of Initialization *- It is deemed that this contract is initiated and finalized in Wasatch County, Utah. Any legal action brought by the Buyer or the Breeder will be preceded with a court appointed mediator. Any legal action will be ignited only in the county of initialization and finalization which is Weber County, Utah.SECTION 19 - Execution *- This agreement is considered executed and a legally binding agreement at the time and forward that the Seller delivers the dog for transport.SECTION 20 - Breeding *- If it is the opinion of the Buyer at anytime that the dog should not be bred for any reason, the buyer will return the dog to the seller or pay a fee of $2,500.
